Freedom of Information Act Request Does anyone have a form letter for this??

Hi,

I realise it is simple enough but my brain is fried ATM.

Situation is that ACC has passed on an assessment to another gov't department which they are now using. I haven't seen the assessment yet and am really concerned that a large portion of its contents are incorrect.

Acc tell me that they CANNOT release the assessment until they have made a decision (this is for a sensitive claim lump sum/independence allowance), and that it has been held up because the assessment (GP employed by acc to assess %) is in disagreement with the ACC psychiatrist report that I HAVE read, and I fully agree with. Needless to say this is stressing me out big time and it has dragged on for months (evident in another thread I posted....).

Can someone help??

A copy of the IA/Lump Sum assessment can be released before ACC makes a decision, as with any assessment that is about you. What happens is ACC has the assessment report peer reviewed to check that it has been done correctly. But because of the way the assessments are done (using the AMA guide) it can be a little confusing as to the way the final whole person impairment (WPI) is arrived at.

This tends to get the claimant all excited and so when the decision comes it can be different to what the claimant was expecting. Invariably, the WPI and the payout is usually disappointing and the claimant disgruntled. It is probably one of the biggest gripes claimants have about their entitlements outside of the vocational rehabilitation.

Therefore, ACC don't like providing the report until its been peer reviewed and they issue a decision on the payment.

Redsquares, you can certainly request it, but just remember that these report only relate to IA/Lump sums and really don't have alot to do with anything else ACC might be doing apart from there may be a recommendation for counselling if its a sensitive claim.

Just to add to what waddie has said is

The Gp assessor is more than likely not qualifies to over rule the specialist that has already given an assessment.
