Dear Sir/Madam

Re: Disputes Resolution Services, a wholly owned sub-sidiary of ACC.

As reported in the Sunday Star Times (November 17, 2002), the Disputes Resolution Services are charged with determining whether the decisions made by either ACC or Catalyst and or their contractual service providers are correct and is bound by statue to be completely neutral, favouring neither claimants nor the corporation.

Yet they are a wholly owned subsidiary of ACC, just like Catalyst is!

ACC is its sole shareholder and as reported, has the power to appoint or remove directors!

By law, ACC is required to have in place a review process that must be independent and even handed, yet the DRS provides ACC with a monthly “adverse decision report” about cases that have gone against them , advising ACC and Catalyst managers where they have gone wrong and how to avoid similar situations!

The chair of DRS board of directors and an ACC director, Mr. Ray Potroz has admitted the review process is not as neutral as it could be!

It is quite clear by what is reported in the Sunday Star Times that the DRS is in-fact not very independent of ACC!

My complaint to the Serious Fraud Office is that ACC, Catalyst and the DRS are actively promoting the DRS as being “Independent” while it is quite clearly not!

Another complaint is that when either the DRS and/or the District Court reverses a decision made by ACC and or Catalyst which is based on medical reports issued by their medical specialists, the medical specialist is not required to refund the $400 - $500 odd dollars they have been paid for the report!

I see that as the ACC service provider ripping off the ACC levy payer! If they want to keep the money, they should do their job properly first time round!

Please investigate my complaints.
