Yes gixxer you obviously have missed out on something! Through these threads you will see that I have made a complaint to the Police on an illegal aspect of the investigation undertaken on me and the Police were attending to the matter. Then all of a sudden, no word. Did the matter get too hot to handle? It looks like it. Hence the complaint to the Police Complaints Authority.

Wth regard to our "friend" Mr Gerard McGreevy. I note the NZ Herald article refers to him as "ACC lawyer". How many hats does this gentleman wear? I understood that his current position was "General Manager Rehabilitation Services", and that he has not been involved in the Legal Services Section for some time. Is it a matter of convenience for him to be referred to as "Lawyer" when the Corporation wishes to trot out a 'hit man'? :wacko

Further thought: If Gerard McGreevy is head of Rehabilitation Services, are we to understand that "Rehabilitation" has a new definition? Does it now mean "removal of claimant from ERC as quickly as possible, by fair means or foul? Why else would a Ventilator-dependent Tetraplegic (e.g Anne Marie Flynn) be required to undergo Vocational Assessment?

It seems anything ACC does regarding me they do with Lawyers. Perhaps that is why McGreevy was stated as being a Lawyer. Don't forget there is a Police complaint in the pipeline regarding an aspect of the fraud investigation - specifically about the way the videoing and surveillance work was undertaken. The Review hearing was undertaken by no less than a Lawyer from the Crown Law Office in Wellington (the Case Manager virtually never spoke a word)who in fact was very kind to me during the hearing! She must have known that ACC didn't stand a chance with their ridiculous fraud accusation sticking! How dare they accuse me of that! If only I could transfer the pain I suffer from, my spine being now pitched forward of its normal anatomical position, onto them and then let's see what they would be saying!

I have this morning written to The Prime Minister asking for an Inquiry. I will advise in due course her, and Ruth Dyson's, replies.

Further, over the weekend I read Judge Trapski's 1994 Report. I wished I had had his Report when I wrote to him! It seems that exactly the same culture is persisting within ACC now. Some say it is even worse. There was an identical situation quoted by Judge Trapski as has happened to me. A woman who was assessed in a private capacity by a certain Specialist got a supporting report from him and yet once contracted by ACC that same Specialist wrote a damning Report about the woman! In my case of course I had the same Specialist supporting me for over a 19 year period (who had alerted me in 2000 also to the fact of the surgeries being a Medical Misadventure)and then doing the turnabout after looking at the 28 min. video which had been selective and edited and he wouldn't take anything I said to him by letter into consideration because ACC told him to send everything on! So much fairness with ACC.............what absolute rubbish!

ACC, why don't you take the word 'fair' out of any of your blurb that you speak of as it just doesn't exist?!
For God's sake ACC, stop the ridiculous 'spin' you put on everything. People see through it.

Have just had a reply to my letter to Ruth Dyson. She says that ACC ".....acknowledges it was precipitous to have made the decision to cease your entitlements at that time." Well, Ruth they didn't declare that to The Ombudsman which I will be telling you again in a letter!

Further Ruth Dyson states that The Ombudsman has concluded a separate investigation regarding my case management and has said that he "....did not find any fault with your case manager." Funny that when the Police tell me that by her and Verifact leaving out the Physiotherapy treatment in the video and/or the Report by these undercover surveillance agents that it is legally termed 'Loss by Deception'. The Lawyer I was using at the time stated that it was Fraud! The Case Manager had been told by my GP very early on in the matter that the Physiotherapy treatment which I had just had before cleaning the car had been left out and yet she didn't attempt to amend the situation. She presented the video to the Reviewer as it was, as well as the Report - that is without the Physiotherapy visit - as I have stated all along, selective and edited. This little visit had a huge bearing on the whole situation. In case Ruth Dyson and ACC are not aware, Physiotherapy (massage and ultrasound) takes a lot of the tension (spasm) out of my back muscles for a short time, hence giving me a window of opportunity to undertake these types of activities in the very short term.

The Ombudsman hasn't even got the Privacy Law correct when saying that it is "reasonable" for ACC to insist on claimants having to sign the 167 Consent form which ACC now feels it can force a claimant,(me- and it seems ACC are using me as a precendent for same), by threatening dis-entitlement when this is quite incorrect. The Privacy Laws state that a claimant can insist upon getting ACC to ask for consent each and every time ACC wants to approach an Assessor, (confirmed by a senior law practitioner in Dunedin as well as a Professor at Otago University)as well as getting agreement from the claimant as to what documents can be sent. It has come to this with me due to all the flawed Reports/videoes on my file which ACC refuses to do anything about even though I have written several times about, but had no answer.

It was due to the Privacy Commissioners decisions and the decisions coming out of the Ombudsmens office, that I wrote to Judge Trapski asking for an Inquiry.
It is to be hoped that Juge Trapski has now enlightened Ruth as to what is going on in ACC!

Ruth Dyson continues to ask and receive ACC's word about matters of claims management whereas she should be coming to the claimants who are stating that they are receiving completely unfair treatment from ACC. Established practice when investigating matters should come from both sides of the argument, not just the one side - that of ACC or The Ombudsmens Office etc. This is why there continues to be the chasm there is between ACC and its claimants.

Good post Limoges and your last paragraph is spot on, IMHO. Notice how quick the pollies were to start a witch hunt of TVNZ over $100,000 for an autocue reader, compared with their studies inaction over an inquiry into ACC's treatment of the long term injured.

I think that a number need to look at this report and see if this is the same behaviour that is being conducted by ACC.

• see if the questions asked to the assessor is the questions to see if entitlement should be supplied
  
• Check to see if the case manager has advised of all of the covered injuries,
  
• has the office of the complaints investigator carryied out the necessary investigation
  
• check out the qualifications of the medical Profesionals;
  
• has the BMA claimed injuries not covered or there is a typographical error.

$30 million is a lot of money for an individual to have and then gift.

It is more than what was recently spent on the NZ Flag Referendum, and almost as much as what the Auckland Council's Albert St headquarters have spent on re-cladding there building.

Maybe he was very, very good at knowing where to invest when he was originally a lawyer before he became a District Court Judge.

We would be most interested in learning more where he invested and where the funds originated from.

Would some good investigative journalists please find out and let us know as we would like to know his secret.

The legal community is set to benefit from a $30 million gift from the late Judge Ian Borrin, thought to be one of the largest single-purpose bequests ever made in this country.

The retired district court judge, who dedicated his life to the law, died in March, aged 81.

At a memorial service in Wellington on Monday it was announced he had established a charitable trust devoted to legal education and research that would improve this country's legal system.

It will be known as the Michael and Suzanne Borrin Foundation - named in memory of his parents - and will support the legal community at all levels through grants and scholarships to undertake legal writing, research and education.

It will be administered by the Nikau Foundation, with funding decisions made by an advisory committee established by Borrin himself.

The committee will comprise the Chief Justice of New Zealand; the President of the Law Society; the Dean of the Law School at Victoria University; retired Chief Judge Thomas Goddard and his alternate David Goddard QC; and a representative of the Nikau Foundation.

Foundation chairman Chris Milne said the $30m fund was a marvellous legacy left by a man who had dedicated his life to law.

"Ian Borrin was a humble and gentle man of integrity, who sought no recognition for his generosity," Milne said.

"The establishment of the foundation is extraordinarily generous not only in its scale, but also in the impact such a legacy will have in perpetuity for the good of New Zealand."


Chief Justice Dame Sian Elias said those who could apply for funding included judges from all New Zealand courts, both retired and serving, as well as practitioners of both public and private law.

But the real beneficiaries would be the people of this country who live under the security of law, she said.

"It is entirely consistent with the way in which this modest, kind and scholarly man lived his life that this parting gift is one that looks to the future with optimism. We will all greatly miss this good man."

Law Society president Chris Moore said Borrin was highly regarded in legal circles for his compassionate approach and generous spirit.

"The Law Society has no doubt that our legal and justice system will be measurably enhanced by this legacy. It is a fitting memorial to the man and his parents."

Victoria University Pro Vice-Chancellor and Dean of Law, Professor Mark Hickford, said Borrin's generous bequest would significantly help those who study and research law in this country.

Members of the grants and scholarship committee have yet to meet to discuss the finer details of the fund. It is likely to be a year before the first grants and scholarships are awarded.

WHO WAS JUDGE IAN BORRIN?

Ian Borrin was raised in Wellington and attended Wellington College before studying law at Victoria University.

He was appointed to the District Court in 1983 and served as head of the Police Complaints Authority, retiring in 2007 at the age of 72.

A keen traveller and skier, Borrin's rare combination of experience qualified him for membership of the Federation of International Skiers, an international arbitration court that heard cases relating to ski racing at its highest level.

He is survived by his partner Jenny George.

Doesn't this just show that someone who is known to all to be a very fair human being with a lot of standing in society has shown that he also believes there are untoward things happening at ACC from what he has been hearing, obviously for some time now. Why is it that all those closely connected to ACC will not take on board the rogue goings on of ACC and furthermore do something about it?

Judge Ian Borrin, former Police Complaints Authority and Wellington Judge, died this week after succumbing to cancer. The quietly spoken Judge was a keen supporter of Victoria University’s Law School, supporting numerous activities, including the VUW Law Review, but he was also possibly one of the wealthiest men to have occupied the New Zealand bench in recent times, if not ever.

Judge Borrin’s parents were European and built a substantial business in New Zealand through the Peerless Handkerchief Company as well as through substantial property interests in Wellington City and elsewhere. Although Judge Borrin lived a humble existence it is thought that his wealth was very substantial and ran into the multiple millions.
