GOOD BUSINESS PRACTICE OR YET ANOTHER ATTEMPT TO PERVERT THE CLAIMANT'S CHOICE OF TREATING SPECIALIST

Three eminent Christchurch and highly respected (formerly) orthopaedic specialists appear to be collaborating with, or have hired, one Dr. XIONG Xianghu Hu to act as a gatekeeper who decides whether or not an ACC claimant will be passed on the the Lords on High for further assessment and/or treatment.

Dr. Xiong is well-known to us in the South as a doctor who purtports himself to be, among others, an orthopaedic surgeon/specialist, it is also well-known that ACC purports him to be a specialist. He is a travelling carpetbagger - ACC toadie assessor who travels around the country assessing claimants for IMA VIMA and medical updates.

This information came to me via a claimant who received a letter from ACC advising that the three named specialists will accept referrals from the infamous Dr. Xiong for processing, including obtaining MRI's etc. I hope these specialists are aware that Dr. Xiong is only a GP and therefore can't organise or authorise MRI's on his own account. Furthermore, the claimant's letter stated that one of the specialists is not accepting referrals from any other source.

I wonder where ACC fits into this cosy little scam, the letter came from ACC so obviously it knows about it and in all probability not only condones the practice but also colluded in setting it up.

Another underhanded method to control the whole process and deny your right to choose. What next?

the next step will be that if there is an accident Dr Xiong will be providing an assessment before any treatment . do't think that this is good ratices but a money scam to be collected off ACC.

NO ARGUEMENT... NO DEMANDS... NO THREATS of being cut off if you do not
"DO AS I SAY"... from CM...
Not all of us can afford to pay for assessments up front... But if you can, it's the best way to go... A better guarantee of an "Honest Result".
Supply as much of info / Documentation as you can...
Dont forget the Consent forms as well.... TO CM...
They will send these on with the Documents they send...

Get the report, check it, then send / deliver, it to CM... Who must then pay for it...
If they refuse, then it is on their head... NOT YOURS.
They cannot say you are being none compliant.
There can be "delays", with this process, but not created by you...

If your CM decides to be a proverbial "A... H..." Then request a change of CM...

I have, and others have done it this way... and it is surprising how many adverse comments you will get re ACC... and of their "methods", from who you go to.

There is clearly a conflict of interest here. If ACC is requiring this there is also a conflict of interest and bias on their part.

Granting deference to a particular doctor runs contrary to the very idea of ACC having a discretion.

For example, when the treating doctor and the "independent" assessor come to different conclusions about the claimant's condition the ACC must still determine the question of disability when has a conflict of interest. (i.e. getting you off the scheme and money/investment considerations.)

The UNUM case threw up the principle that in any review, - which is from the beginning (de novo) by virtue of s.145 - there must be an analysis of conflicts of interest on the part of the decision maker - and the nonfiduciary doctor- and that involves full discovery of documents by ACC.

I refer you to our review judgement (posted on the site) that confirmed that a claimant has the right to choose own provider, as long as they are qualified and able to do the treatment/assessment etc. ACC CANNOT REFUSE YOU THIS!!

Hmmm my CM told me he was one of the top guys at Burwood... and I was "lucky to get an appt so quickly".. Pity I didnt tape that phone call.. Mind you I was extremly dubious about the appt.. seeing as the CM was intent on getting a VIMA done before I'd had a complete assessment by Dr Finucane. (Which bty had been on my IRP for the previous 8 months!)

And although his report is 90% halftruth I cant complain too much..

"Fit for part-time vocational training" has placed vocational training firmly on the agenda...

You are absolutely right!
Xiong is now the big shot at the Spinal unit. The former Director with all his wonderful expertise and quals has been replaced by this prick who is an absolute ACC toady.
ACC actully fund this unit it seems and of course the Director is one of their mates.

If you have any complaint about your treatment by Xiong, go to the HIGHEST echelons of ACC and DHB,Hospital etc and make a huge noise. It is time a big lot of complaints were lodged about this guy....

Judge ruled he had the right to choose, so acc should not have deemed him non compliant...

please read all case law 1st, to ensure it is completely relevant to your case! before adding it in to your own case...
