The ACC, with the assistance of private investigators, made false allegations against Ronald Donaldson alleging that he had worked in the company he owned beyond what he had described. The ACC succeeded in a criminal prosecution for fraud resulting in a three-year prison sentence.

The ACC failed to describe the end of Mr Donaldson's incapacity as is required by legislation. Instead the Corporation generated the illusion of work activity without any substance whatsoever let alone demonstrating earnings or be earnings capacity. The Corporation have also successfully prosecuted numerous others in the same fashion some of which do not have the financial resources to appeal.

In the coming days the court will issue the full acquittal notice. The state entity, ACC, attacked a citizen of New Zealand with false allegations committing perjury with the assistance of private investigators. This will be a major media event.

Members of this forum provided the case law that was used to demonstrate that the Corporation knowingly misled the court. This site really works.

:D Will be looking forward to seeing this in the press ...

This is one step on the long road to reining in this corrupt organisation ..

Hmm ...

Is there any way charges can be laid for purgery against the ACC witnesses and/or the PI? It would be a start ...

Would it be possible for Mr. Donaldson to sue for both damages and for loss of earning potential either from his companies or himself for the time of his imprisonment?

That poor chap deserves so much better ...

That is shocking Nessa, your friend in no uncertain terms should not accept the situation of them going her for fraud. Surely her doctor could clear it up in a few minutes by explaining about her memory loss and confusion due to the injury. What miserable twit would persecute a person who doesn't have a chance of understanding their lowlife tactics. Ring your local politician and get them to sort it out pronto - and don't let her be put through this without a fight. If the MP or doc wont help, there are lawyers who work pro bono at local community centres - see citizen's advice or a beneficiaries' union type of outfit -- someone on here will have more idea than me -- but don't let the bugger use her as a doormat
cheers
