Canada is becoming increasingly less sympathetic
towards the weak, the poor, the injured and the
disadvantaged. This mindset sees such individuals as a
drain on society and, in particular, contrary to the
economics of profitable business.We were once your
brothers , sisters , fathers and mothers and still are
.
Certainly the cost of disability is an important
factor that must be considered. However, we seem to
have crossed a threshold where it is increasingly
acceptable to demonstrate a lack of empathy or
compassion for anybody who is injured Governments not
only fail to display compassion for injured workers,
but displaying such compassion is seen as weakness for
not staying the course of significantly reducing
direct costs. With health care professionals there is
an obligation to point out to our politicians and
society in general that there is a significant human
cost to policy changes. Short-changing people when
they are most vulnerable is going to increase
suffering markedly while simultaneously swelling the
welfare roles and transferring the problem to other
jurisdictions. Although such measures may well force
some individuals to return to work who might not have
otherwise done so, the fact is that the vast majority
of individuals are likely going to end up without
resources at a time when they need them the most.

Prevalence of disability in Canada The disability rate
increases with age

Survey results confirm that the disability rate
gradually increases with age. From 3.3% among children
aged 0 to 14, it rises to nearly 10% among adults aged
15 to 64 and climbs to more than 40% among persons
aged 65 and over. In fact, more than half (53.3%) of
persons 75 and over report having a disability. Within
the population aged 15 to 64, this gradual increase is
reflected in a rate of about 4% among young adults 15
to 24 years of age, compared to 7.1% among persons
aged 25 to 44 and 16.7% among those aged 45 to 64.
* In 1991, 4.2 million Canadians, 15.5 per cent of
the population, have a disability an increase from
1986, when the number of people with a disability was
3.3 million, or 13.2 per cent of the population.

* Prevalence of disability is closely related to
age, with the disability rate ranging from 7 per cent
of children under age 14 to 50 per cent of those over
age 65. The rate of disability for working age
Canadians, aged 15 to 64, is 13 per cent.

* Working age Canadians (age 15 to 64) number 2.3
million, or 59 per cent.

* People with disabilities are much more likely to
live in poverty than other Canadians. Of adults with
disabilities, 43 per cent had an individual income of
less than $10,000 per year and 26 per cent had income
of less than $5,000. Adults with severe disabilities
are much more likely to be poor than those with mild
disabilities. These figures do not take into account
the extraordinary costs associated with disability,
which can be substantial in many situations (see, for
example, Federal Task Force, 1996; Perrin, 1991;
Roeher Institute, 1994a).

We are all Canadians who happen to live in BC Whether
or not you voted for the current governments , we are
all responsible in some way for allowing certain
conditions to exist and we are each responsible for
getting us out of this mess .I don't know about any
other Canadians but I certainly didn't give my
permission to any government official to exploit the
rights of another . If you look at the pattern in BC ,
here's what I see . The new Acts the current
government enacts amends or repeals anything that cant
be addressed.The Acts contain legislation that gives
them ultimate authority.That is not a democracy it is
a dictatorship.The difficulty is we as citizens are
not privy to this hidden agenda.The Acts in place do
direct one to the mentality here.So this is what I see
now

So at first the government held hearing to see where
that they had not thought of eliminating. BC 'ers were
tired of governments so most of us were quite willing
to participate in these hearing.As we thought change
was coming.Weren't we deceived

So from that point the onslaught started The Labor
Code , the WCB act .The Finance Act the PERSONS WITH
PERSISTENT MULTIPLE BARRIERS,Legal Aid Act ,
Significant Projects Streamlining Act, Parks and
Protected Areas Statutes Amendment Act, 2003, British
Columbia Railway (Revitalization) Amendment Act, 2003,
Miscellaneous Statutes Amendment Act (No. 3), 2003
,Medicare Protection Amendment Act, 2003, Insurance
(Motor Vehicle) Amendment Act, 2003 , Health Sector
Partnerships Agreement Act Railway and Ferries
Bargaining Assistance Amendment Act, 2003, Timber
Licenses Settlement Act , Municipalities Enabling and
Validating (No. 3) Amendment Act, 2003 ,Canadian
Pentecostal Seminary Act these are just some of the
acts there were going to be totally revamped or made
impossible to address.Any legislation that goes
against their beliefs have been revamped or repealed.


So bill 69 , or the WCB amendment act saves the WCB of
BC approximately $100 million dollars a year The
government also created a new appeal system called
WCAT . Many appeals went missing From these Acts

" Board decision-making from the WCB Act "

99 (1) The Board may consider all questions of fact
and law arising in a case, but the Board
is not bound by legal precedent.

"an action may not be maintained or brought against
the Board or a director, an officer,
or an employee of the Board in respect of any act,
omission or decision that was within the
jurisdiction of the Board or that the Board,
director, officer or employee believed was within
the jurisdiction of the Board;"

According to the Disability Awards "it is up to the
WCB of BC to determine the extent of the impairment
and whether that impairment results in a disability
.The assessment of that impairment must bear in mind
their expert opinion of the Medical Assessors."

WCAT appeal decisions are final and conclusive. There
is no further avenue of appeal.
255 (1) Any decision or action of the chair or the
appeal tribunal under this Part is final and
conclusive and is not open to question or review in
any court.

The amendments and changes also made to the B.C. Child
Labor Law On October 8, 2003, and the B.C. Liberals
passed in third reading changes to the Employment
Standards Act in Bill 37 that gives British Columbia
the dubious Honor of having among the weakest labor
standards for working children in Canada, possibly all
of North America. Children as young as 12 will be
permitted to work at a job with only a note from their
parent. The Minister of Skills Development and Labor
promises new regulations regarding safety, hours of
work, and supervision but until then the proposed
changes would remove any onus on the employer to
ensure that children are not assigned to night shift
or to an inordinate number of hours in a day or week.

legislation currently is in this particular instance.
The director of employment standards is still required
to do the permitting for children under 12, so as is
the current situation for under 12, they would still
have to go and get a permit from the director of
employment standards, and the director at that time
would make the determination - just as is currently
the case.)


Children now have to have work hundreds of volunteer
hours to graduate high school The first 500 hrs
children work now are $6.00 an hr . Then they can work
for minimum wage .

The current government added $4000.00 to the $16,000
making the MSP subsidy limit $20,000 Saying they did
it to aid low income families get a 100% an MSP
subsidy The current government eliminated the db2
rating for a disability .replacing it with the PERSONS
WITH PERSISTENT MULTIPLE BARRIERS saying " The
Employment and Assistance for Persons with
Disabilities Act has been
established to recognize the distinct needs of people
with disabilities.The new legislation provides support
and assistance for people 18 and over who have a
severe mental or physical impairment that
significantly restricts the person's ability to
perform daily living activities either "continuously
or periodically for extended periods".They added a new
form that they say cost $23 million dollars .This
allowed them to say a disability is " cyclical or
episodic in nature " and the minister could revoke or
deny a persons disability . This so the monthly
benefits to persons and families was reduced and a
doctors money for participation in filling out the new
form was increased .
They also created the " BC Employment Strategy for
Persons with Disabilities April 2002" which was and is
a dismal failure.But if one doesn't
submit or comply to this plan , they could be cut off
benefits The established employment plan made by the
ministry cannot be appealed .

The government admitted that there are approx 55,000
individuals receiving disability benefits each month
This addition to the MSP helped no one who is getting
disability or working for minimum wages.Many don't even
get $10,000 a year

But one must report the positive outcomes of their
working plan As the provincial tax has been lowered I
do save 16 cents a month

It becomes obvious changes are needed We need to
address all our common needs .We all know what works
and what doesn't work
We need to be able to say " Our ways are not a better
way , just another way , "
