Dear Clerk of the Health Select Committee

Public Submission
Injury Prevention, Rehabilitation and Compensation Amendment Bill (No3) ACC Medical Misadventure.


This reform is long overdue.

ACC declines most cases after 9 months, as the system is adversary to the patient. The patient feels let down, without any cover for rehabilitation or compensation. The patient receives no assistance from anyone as long the case is not accepted by ACC.

It puts the patient and doctor in conflict, conflict through the system. Next the review takes too long and doctors bring their lawyers against the patient. Everyone else benefits not the patient

The DRS Ltd are not independent, they are trained and paid by ACC, not when the reviewer (Beverley Archer) is an ex ACC manager and they like ACC predetermine the outcome. In fact I had to force the reviewer to allow us to read out evidence against the surgeon involved and we felt all the way through the process that they were simply putting us through a mere formality without any substance and to simply to attempt to year down the victim so that they would go away and leave the health professional and ACC alone. In our case the case manager (Warren Macguire) determined the outcome before he even read the so called very highly paid independent advisor's report.
This is not natural justice in our eyes.

ACC encourage doctors to cover-up mistakes and the systems has become adversary to the patient and more favourable to the medical profession and don't they just love it, to close ranks on the affected victim

The patient receives no help from the doctor or ACC. We are worried that patients are having to wait too long and are not rehabilitated under this system.


The ACC system blames the patient for the Medical Misadventure, Mishap and Error. As soon as a victim exercises their rights to complain and put a claim in that is supported by the GP they then lose all their rights to a fair and thorough hearing.

The patient has to prove the wrongdoing, while the perpetrator gets off scott free.

The information pamphlets are not given in time to the patient. The patient is left uninformed.

The booklet are all written for the patient, but the patient has not been given the right information and has often no idea, how the system works.

ACC is not helping as they say in the booklets

Everyone is out to block the patient to receive the help they are entitled to.

ACC should train their staff to assist, but this is not happening like the rest they simply don't care because they have not been subjected to the treatment that ACC claimants arc put through to coin a phrase - sheer hell already added to the sheer hell they are already experiencing.
