IA backdate

Hi all we have a couple of issues with case file. First was the corporation had a claim as 1993 but it was 1985. The Hospital screwed up and my left ulna was broken as a young teen. It was never set properly and as a result it broke again. This time it was in the states it then got reset with a rather large bow in it. Now I sprained my thumb in 1993 and my file states thumb sprain. Now my left ulna at this point was giving trouble, so went to the specialist at some stage of the early to mid 90s and then again in 2000. The surgeon got my file from the DHB and wrote the corporation a report and in the report was the 1985 injury date he stated to the corporation that this injury was from 1985. The surgeon had informed the corporation there was another injury that was not in their system. One would have thought that at that point the 1993 claim would have been declined. No it was not. So many case owners later and we bought this to the corporations attention when we actually found out (ptsd so dates can be a bit fuzzy) which was in a photo with a cast on. So in 2016 we went to the DHB and asked for the file as did the corporation (the records lady stated the corporation only wanted to 1993). Then a big fight began and we never knew where to turn over this it nearly came to a court case so we backed off for a bit. so fast forward to last year the latest case owner finally after 20 years of no one reading it or bothering to deal with it decided to get their exit doctor Mr Hartshorn involved to resolve this once and for all. He agreed with us. The date was dutifully changed to 1985. Now we put through the IA application and got 10% impairment. In the meantime we asked the corporation what their intentions were as to the payment date. They have chosen to pay from date of application instead of when they were notified by the surgeon there was in fact a different date. Now am I liable for all those years through several case owners and several reviews referees included. I am of the opinion the corporation should have done their due dilligence at the time of notification and declined cover at that point. Now we are of the opinion this should be backdated to at least 2000 due to this being beyond our control. How does a thumb sprain become a full blown ulna reconstruction with several operations anyway? Am a bit confused as to who is in the wrong here? I do know the hospital in 1985 was and they were up to the point of the surgeons report to the corporation, but it is after that. Any help would be much appreciated as we have reviewed the corporations decision on this after who reads files? They have decided to go very quiet and wont respond to the how many case owners and reviewers have supposedly read the file.
