Hi all we are having an issue . It has been ongoing for quite some time. The date of injury the corporation has is 1992 . Now the date of injury the DHB has is 1985. Now the corporation is stating a private surgeon was in the emergency room when he has never worked in the public sector. Now we have been wondering where 7 years of medical file was , so we went to the DHB and asked what date the injury was. DHB stated there is a file for ulna break in 1985. The 1992 was the second surgery (first was emergency room 1985). The corporation has refused to accept this. Now here is where things get interesting. The DHB in 2017 at our request when the corporation requested the file they sent the previous 7 years in 2017. Now asking the corporation what the date of injury is when a new case manager came on board and the answer was 1992. This was only a few weeks ago. Now they have provided an assessment with Dr Hartshorn. I have explained to the Doctor and the corporation the file is incomplete , they are adamant that it was complete. So we went to the DHB and obtained the file 24 hours from request over the phone to picking it up. Now archives we believe is in paper form and they stated to us that this was in fact provided in 2017 to the corporation. We sent another email to the corporation asking where the file was and have had no response since. Now the issue is the doctor does not seem to care that the file is incomplete and the assessment is going ahead. There is no weekly compensation. Should the assessment be attended or should it be held off until the corporation provides the entire file to the assessor? There are lots of questions but this is the first.

Wait for complete file, look at privacy act or health information privacy code and tell ACC.

Accuracy of health information (rule 8)
Before it uses or discloses health information a health agency must take reasonable steps to check that information is accurate, complete, relevant, up to date and not misleading.

Get your file in order before any assessment, request complete file from ACC. Before you go for any assessment get a list of all information that has been provided and take everything with you to assessment regardless because ACC leaves stuff out.

ACC is making habit of losing old files, suddenly they go *poof* and they're gone. Imagine that?

They don't like those claims under the early 1972 and 1982 Acts which you 1985 injury is, but chances are the 1992 date ACC want to use falls under the broken 1992 Act.
