Hello all. There is a lot of case law out there about how ACC trained assessors apply apportionment for non covered events. There is a lot of case law around this controversial topic & yet ACC will still endorse this dodgy topic. I will copy & paste the cases that are out there. If you are in receipt of an independence allowance & have had your whole person impairment applied to non covered events. Tell ACC that there is case law that says all claimants are entitled to receive their full entitlements to the independence allowance. Here is the case law.
C T v Accident Compensation Corporation [2014] NZACC 273 (21 October 2014)U v Accident Compensation Corporation (Independence Allowance) [2018] NZACC 28 (8 February 2018)R v Accident Compensation Corporation [2014] NZACC 218 (16 September 2014)S v Accident Compensation Corporation [2008] NZACC 262 (20 October 2008)Fowler v Accident Compensation Corporation [2005] NZACC 367 (15 December 2005)
Gardner v Accident Compensation Corporation [2002] NZACC 22 (25 January 2002)
JS v Accident Compensation Corporation [2004] NZACC 257 (27 August 2004)D R V ACCIDENT COMPENSATION CORPORATION HC WN CIV 2008-485-1584 [2008] NZHC 1951 (9 December 2008).
As ACC can't even follow case law it makes me wonder what on earth they are hiding. Enjoy reading the case law for this controversial topic.
