Privacy Commissioner advice good advice

I've just been given some good advice by the Office of the Privacy Commissioner.

If you discover that ACC has not complied with Privacy Principle 8 then apply, as the case may be, to the reviewer or to the Court to strike out ACC's submissions/evidence as an abuse of process.

In doing so, make sure that you can show that what personal information ACC has used to the reviewer or to the Court is not accurate, up to date, complete, relevant and not misleading -

In other words, does ACC's evidence/submissions comply??? - that is the remedy.

An agency that holds personal information shall not use that information without taking such steps (if any) as are, in the circumstances, reasonable to ensure that, having regard to the purpose for which the information is proposed to be used, the information is accurate, up to date, complete, relevant, and not misleading.

Another EG :

Principle 8 is relevant if a decision affecting an individual has been
made on the basis of incomplete, outdated or inaccurate personal
information. Information privacy principle 8 says that: An agency that holds personal information shall not use that
information without taking such steps (if any) as are, in the circumstances, reasonable to ensure that, having regard to the
purpose for which the information is proposed to be used, the information is accurate, up to date, complete, relevant, and not
misleading.
