claim declined

Got the news today that my claim has been declined due to lack of medical evidence, i will now be going to an advocate for further advice i had a disc protrusion 7 years ago when it happened i got sent to my doctor and he said theres nothing wrong go home and rest i went back few weeks later and got the same advice to go home and rest i have now further symptoms and arthritis and so on but i have no medical scans on the day it happended because i was told by my gp to go home and rest so i did 7 years later im suffering these nasty nerve pains and sure heaps of tingling on side of head and acc have declined me so i have to live with it.

The best advice is to go to a new doctor and asked for a full and complete diagnosis of your condition. It might be best to go with written notes as to all of the information regarding the accident event together with a complete set of symptoms from the beginning right up until the present. Failure or the original doctor to make a proper diagnosis is medical misadventure.

The new Dr upon finding that you have actually been injured from your accident event and has determined that there has been an incapacity well then lodge a new claim backdated to the time of injury. The ACC will then have to treat this as a complex injury which would require them to carry out a full and comprehensive investigation which will necessitate that they take full account of the new doctor's diagnosis and recommendation for treatment..

If your doctor never filled out an ACC 45 when the injury happened years ago,

then you will have a big job to get it put right now.

/the moral of the story is, Always get an ACC45 filled in when you are injured, even if the GP doesn't think you are injured

The claim must be made to get your entitlement, even at a later date.

your injury is obviously from an accident but the ACC are right, no ACC 45 no entitlement.

you can ask to see a specialist and see if this can be made an accident retrospectively

you will need scans etc to prove it

Thanks for advice everone

When the accident happend i was pushed, i went flying into a car wacked whiplashed my head on the car then fell face first into the concrete driveway.

I have cover for the claim as Gp filled acc form at the time of accident all those years ago but he also passed away during that time hes gone now and i have a new Gp and hes good he is the only way i can apply for any cover so ive made a good relationship with him and he will give me all he can cause he knows im getting the big run around but the run around stuff isnt easy for me its basically having appointments with my gp and getting referals to acc to cover this and that and if that dont work i have to go back to gp and apply to acc again and again ive had multiple decline letters as im living with my partner and she has to do everything for me and also our 6 kids im not working because of the awful sensitive pain effects everything i do.



They acc Mri me in 2015 it came up with 2 disc prolapses in c5c6-c6c7 and there was some other stuff osteofytes boney bar inm not really sure but definatly 2 prolapses. Then Acc only choose to cover the c6-c7 prolapse a year later i thought thats not right ive only had 1 accident to my neck so i have new claims in for the face plant and the other disc prolapse c5-c6 and am thinking of going to gp agaim to get another claim where i hit the car or concrete and my head suffered a whiplash motion(another brain injury?) as thats the only way how the prolapse/s happended somehow for some reason my gp ignores me when im telling him as im not sure why hes hesitating to accept what im telling him what happended beacause acc wont give me any more entitlements until my Gp sends in threse referals properly or all together as im always telling him my head has been involved in this trauma aswell and they tell me i only have a disc prolapse and we acc will only cover physio to mobilise actually they put me through 2 comprehensive pain assessments and the result was i have to do physio and phycology and i must of went to 1 pcycology and had physio at home about 5 times it was very pathetic(hoovering) as none of it worked so i ditched it for now and push on with the rest of my claims.

They acc CT scan and steroid injection in back in 2016 after went to see neurosurgeon he said i had increase in c6-c7 now nerve is 80% compressed and theres some compression to cord so he fills out acc surgery form and seeks surgery asap then tells me i need to stay at a nearby hospital before and after surgery and bring my family too as they will accomodate us but 2 weeks later ACC declines us saying there will be other problems even if surgery is done as this was my first neurosugeons in 2015 advice to acc.

so i will wait till my new claims are accepted or not if i get declined for any of these 2 injuries i will take anyones advice on lawyers and recommend someone tell me how, as im gona go to fairrway and then see if that works i suffered major trauma to my head that day i cant beleive how my past gp(passsed away) treated me the day i presented myself to him with a stiff neck and all round my neck and told him its very sore he did try to move it a bit and i said its to sore what are you doing he laughs and says i only have a neck sprain and a stiff neck totally ignores my accident details puts on his notes patient has a neck sprain then tells me go home and rest went to him again he says nothing wrong theres no pain in my arm go home and rest so i did that for thenext 7 years and am in the same position today still resting waiting for that fix have had little releif on pain killers but im intollerant so out those go i explained this to Health and Disabiltity they said Gp has passed away we will take no further action on anything relatedto that Gp im thinking what a load of CRAP i believe that Gp that passed away ruined my life and is the reason i still have multiple injuries he was very neglective he presented to me with alot of negative advice which only led me to all the crap i have to go through now but hes gone so i cant send him any letters or disrespect his name and shame him/it for the bullsh.t he is still putting me through.


Please let me know of your thoughts any advice will be taken seriously im at the top of the scales with ACC i am ready to Battle any one in my way including the dead.

You have described a deterioration of a covered injury. osteofytes is due to injury in most medical documentation. Your disc have narrowed due to your activity due to incorrect medical advice. suggest that you make a medical error complaint against the original Doctor.
