Blogger Cameron Slater (a.k.a. Whale Oil) was convicted in the District Court of breaching suppression orders on his blog. There is a good summary of Cameron's situation on Lance Wiggs Blog http://lancewiggs.co...do-it-properly/

Will Blogger Blurb be next?

Read up on the Law------> Criminal Procedure Act 2011

Thanks for that netcoachnz

I think Blurb is going to get found guilty, as I quote this one liner below which was said to be made clear from the judge in the case of Cameron Slater.

The penalties are quite small @ 1000/ offense But will likely gain a criminal conviction alongside.

Hopefully a ban from the internet for a few years would be seen as appropriate..

Linking to offending information is probably the same as publishing it yourself.

I see a conviction being imminent for BLURB,, as the name and pending charges were linked within the confinds of a post which was clearly intended to reveal the suppressed name.

This was done after the fact of the being clearly aware of the court order.

I guess its all about due process for BLURB Slater :D

I've been waiting all night for the Police to turn up Rex and still I wait.

If they turn up at around 6AM I'll have a cup of tea waiting for them, along with all these screenshots of your abusive, intimidating, harassing and threatening posts that I've printed off.

And I think my neighbour has a few to show them as well where you've abused, threatened, harassed and intimidated her Rex!

All unprovoked attacks.

She said that she felt sorry for your wife having to live with an abuser like you!

Good luck.

I'd say theres nothing worse than waiting..

You wouldn't believe the amount of approaches from supportive members I've accumulated over my standing up to you, Mini, and the wench pack.

If you need a top up of your hard drive, just let me know and that will be arranged without any wait.

In fact it may pay ya to set up a spare extrernal terabite soon if you are still able to log in. ;)

Another threat Rex?

The only supporters you have on this forum are the Nottinghams, David Butler, Netcoachnz and Alan Thomas!

And they're all renowned for doing what you do, troll, abuse, threaten, harass, intimidate and stalk the genuine members of this great forum.

Got no wise crack comment to make about that Rex?

Must be true then. You're an abuser!

Tristan Barker encourages online harassment
He is a blight on society, say police
I would consider myself an entertainer, he boasts

EXCLUSIVE: THE son of a top musician has been unmasked as this country's most prolific internet troll and is being investigated by detectives for online "stalking''.

Tristan Barker, 18, who has a track record of terrorising vulnerable members of the community, said his aim was to see how far he can push his 300,000-plus teenage internet-subscribed fans.

But frustrated Melbourne police are unable to interview him because he is in New Zealand living with his star dad, Michael Barker, a former drummer of Split Enz and John Butler Trio fame.

A News Ltd investigation has revealed recent Melbourne school leaver Tristan Barker has used internet portals Facebook and Twitter to encourage harassment and ridicule of everyone from Muslims, businesses, local and overseas celebrities, murder victims and people who have committed suicide as a result of online bullying.

As well as using his own personal Facebook, which has more than 300,000 "friends'', to push nasty crusades, Mr Barker is also a ringleader of Facebeef, a Facebook group page with 43,000 "likes''.

In an exclusive interview Mr Barker admitted to causing havoc online whilst high on "Red Bull and Ritalin''.

"I would consider myself an entertainer,'' he boasted.

The type of comments Mr Barker litters the internet with are in stark contrast to the lyrics about love and peace originating from the Aussie roots band, John Butler Trio.

Cyber safety specialist and former police officer Susan McLean said: "He would have to be Australia's most prolific troll. He has no concept of common decency and is a blight on society.''

Melbourne's Detective Senior Constable Rodney Andrew confirmed a "current investigation" focused on an online campaign Mr Barker spearheaded last year targeting Royal Hair Extensions had been launched.

It is alleged Mr Barker had his online fans harass the company's owner Melissa Meitz during a period she was running an online contest. Ms Meitz was bombarded with threatening messages.

The officer said "the offence (being investigated) is stalking, under new legislation that came in a couple of years ago ... it is a continuing investigation".

Mr Barker attained notoriety in early 2012 after trolling pop star Nicki Minaj's Facebook page with an abusive rant that attracted more than 100,000 "likes".

In another rant Mr Barker called on his followers to harass Muslim families by making prank telephone calls. He said he used White Pages to "randomly" search for a family with the Ibrahim surname and phoned them to joke a packet of bacon lay on their doorstep.

"I picked one at random," he said. "It was hilarious." Followers of Mr Barker made similar calls at his request.

Mr Barker said most of his 300,000-plus Facebook followers were youngsters and he was a celebrity in their eyes.

"I see kids follow me and I think 'how far can I rope this kid in and make them be a mockery'," he said.

Mr Barker said his celebrity father should not be held responsible to his online antics.

"My father has raised me quite well," he said.

His dad Michael paid tribute to his son's massive online fan base.

"The people that apparently read his crap on (the internet) is more than most regional newspapers," he said.

Fake trolling story dupes Australian news
AJA STYLES
Last updated 10:01 13/03/2013

Internet troll group, Facebeef, has made a public mockery of Australian news program Today Tonight after convincing the show to run a bogus cyber bullying story as its lead expose.

A member of the group, whose real surname is reportedly Vanmidde, went on the show as "Jasmine Frost", told the show that she had been targetted by Tristan Barker, who had emailed her pictures of male genitalia.

Her story went to air, but none of it was true.

Today Tonight reporter David Eccleston approached Barker, who was dressed in a Nazi costume at the time, for a response to Ms Frost's claim.

In a YouTube video posted after the expose went to air, another Facebeef member "Nebz Adlay" explained that Today Tonight had tried to make a "villain out of a comedian by taking his words out context" so that "when they unmasked him they found exactly what they wanted the world's nastiest man - Adolf Hitler".

Nebz also went on to explain that Barker couldn't be a racist since he was part Maori.

The YouTube reply has already attracted about 80,000 views.

Vanmidde told YouTube watchers that she had acted as a secret accomplice and "all it took was an email titled 'Tristan Barker cyber bullied me' and then a three minute conversation to convince one of the most watched news programs in Australia that I was a poor bullied girl".

She said she had actually been a member of the Facebeef team for the better part of the year.

"Sometimes it really pays to do some research Today Tonight, particularly as not two months prior, I was on the shorts for A Current Affair," Vanmidde warned.

She said ACA did not end up running the story, in which she had posed under a different false name while targeting Facebeef member "Nebz Adlay".

"I don't even know why people keep coming after us saying that we're 'evil', all we really do is be mean on the internet and play dress-ups," said Adlay in conclusion to his online message.

The Seven Network and Today Tonight has been contacted for comment.

Media Week has reported that Barker has since been charged over allegedly slapping Today Tonight reporter David Eccleston when he approached the Facebeef founder for the interview.

Footage of the incident went to air and is available through YouTube but Today Tonight has since pulled the story from their website.

The program told Media Week they had footage of Barker leaving a New Zealand court.

The show also featured an interview with Barker's father, former Split Enz drummer Michael Barker.

Today Tonight presenter Helen Kapalos said on Tuesday's program:

"Last night, in our story on Tristan Barker, the Internet bully, we featured a young woman who claimed to have been bullied by him. This was wrong. The young woman, as it turns out, is an attention-seeker with a history of making up stories. It's not the first time she's deceived the media. She uses false identities and we understand that she's friendly with Barker. Clearly, the young woman has a lot of time on her hands and the less said, the better."

Police can ‘prosecute successfully’ Solicitor General tells MP

The Solicitor General in Great Britain has rebuked an opportunist Member of Parliament for calling for time for police officers to investigate Internet trolling incidents.

Oliver Heald told Steve Rotheram MP that his calls for police to have more time to investigate ‘electronic message faults’ (i.e. flame trolling) was unnecessary. He said about the role of statutory limits in relation to the CPS’s interim guidance on prosecuting Internet trolling that they, “do need to be considered in the context of this consultation (on interim prosecuting guidelines),” but added. “It is important to remember the police investigate the offences, they gather the evidence, and the guidelines are intended to help them as well.”

Steve Rotheram said abuse posted to a memorial page to Georgia Varley, a Liverpool teenager, who died after falling between a platform and a train in 2011, had highlighted the issue of “aggressive, anonymous posts online”.
Internet trolling expert Jonathan Bishop, who runs the Crocels Trolling Academy at Swansea University, says that the Internet trolling laws are in place, but they simply need to be used. “Section 127 of the Communications Act 2003 and Section 1 of the Malicious Communications Act 1988 have been used successfully on many occasions to prosecute electronic message faults,” he said. “The problem is that they are not being used properly, as in the case of the latter, which is not very tough, it being used for the worst flame trollers, and in the case of the former, which carries tougher sentencing, it being used for minor incidents like offensive jokes, which is basically using a sledgehammer to crack a nut.”
“The Malicious Communications Act 1998 was used to prosecute Sean Duffy, who abused the page of Natasha MacBryde, who died in a railway accident in an almost identical way to Georgia Varley, so Mr Rotheram is barking up the wrong tree.”

UK Government Minister, Ed Vaizey responded to Bishop and Rotheram. “When the line is drawn between merely unpleasant behaviour and illegal behaviour is crossed, the Government is happy to work with Members of all parties to ensure appropriate action is taken,” he said. “The Government has taken careful note of the comments made by Mr Rotheram and Mr Bishop.“

Internet Trolls can be Prosecuted Under Australian Law

http://www.findlaw.c...australian.aspx

by The FindLaw Team

The perceived anonymity of the internet makes some users behave in a manner they normally wouldn’t in person, which may be a mistake because an individual’s online actions may have real world consequences. Australia’s first conviction of an internet “troll” who defaced a social network tribute site should be a warning that there are laws that exist to counter bad online behaviour.

The Commonwealth Criminal Code Act (the Criminal Code) Part 10.6 can be used to prosecute individuals who are “trolls”.

What is an internet “troll’?

Internet trolls aren’t loveable creatures with crazy bright coloured hair but rather are individuals who engage in online behaviour that is provocative and offensive, with the ultimate goal of garnering some sort of online attention. Arguably, the most common example of trolling behaviour is posting offensive comments in response to a post or article. However, the explosion of the popularity of social networking sites has seen an increase in trolling behaviour – leading to the imprisonment of the first Australian for being a “troll”.
What are the laws that regulate “trolls”?

The Criminal Code Part 10.6 regulates internet services and some of the areas that the Part encompasses are child abuse material, child pornography, as well as using a carriage service to menace, harass or cause an offence to the reasonable person as stated in Part 10.6, Division 474.17(1).

There are laws at state level that also be used to prohibit offensive online behaviour, such as Queensland’s Criminal Code, as well as the Crimes Act in both New South Wales and Victoria.

Are there any options to stop “trolls” in Australia?

Depending on what type of trolling behaviour was undertaken, there can be a few options available. If an individual believes that they have been defamed, seek legal advice. However, if the trolling behaviour has included content that would normally be refused classification, or classified as X 18+ or R 18+ a complaint can be made to the Australian Communications and Media Authority (ACMA) who can investigate complaints relating to prohibited material.

What is cyberstalking and what is cyberharassment?
Cyberstalking and cyberharassment are similar. Most people use them interchangeably, but there is a subtle distinction, typically relating to the perpetrator's intent and the original motivation for their behavior. While the two situations usually involve many of the same online tactics, cyberstalking is almost always characterized by the stalker relentlessly pursuing his or her victim online and is much more likely to include some form of offline attack, as well. This offline aspect makes it a more serious situation as it can easily lead to dangerous physical contact if the victim's location is known.

Why do people cyberstalk or cyberharass others?

Cyberstalkers are often driven by revenge, hate, anger, jealousy, obsession, and mental illness. While a cyberharasser may be motivated by some of these same feelings, often the harassment is driven by the desire to frighten or embarrass the harassment victim. Sometimes the harasser intends to teach the victim a lesson in netiquette or political correctness (from the harasser's point of view). Often the cyberharassment victim is merely in the wrong place at the wrong time, or has made a comment or expressed an opinion that the cyberharasser dislikes. We've even seen cases where the victim is being targeted because they're the first ones the cyberharasser encounters when they are in a "bad mood."

What do cyberstalkers or harassers do when they stalk or harass someone?

The harasser may post comments intended to cause distress to the victim, or make them the subject of harassment by others.

Internet troll pleads guilty to assault
10:33 AM Wednesday Apr 3, 2013

Tristan Barker outside the Rotorua District Court. Photo / Ben Fraser A Rotorua 18-year-old described as an internet troll has admitted assaulting an Australian TV reporter.

Tristan Barker - whose father Michael is a former drummer for Split Enz - appeared briefly in the Rotorua District Court today.

He admitted assaulting Today Tonight reporter Dave Eccleston in Rotorua earlier last month, after the reporter came to New Zealand to interview Barker about his online activity.

The teenager was remanded on bail to reappear for sentencing on June 19.

Barker has drawn attention in Australia and New Zealand for his online posts, where he appears to have posted material that has upset many people.

Barker has hundreds of thousands of teenage "fans" who read his rants on Facebook and Twitter.

Michael Barker has previously defended his son, saying the teenager had a talent for being satirical, that he had been misquoted and his comments were taken out of context many times.

further I personally do not agree with all this vindictiveness.... I know nothing of all this business with AT, Lauda whatever and the other names mentioned in here. HOWEVER I do recall a long, very long time back having an online conversation with a person bedridden etc, whom was trying to get assistance for herself. The poor woman was in such a state. Any threatening abuse and bullying behaviour is just NOT on.... and shame on those who a responsible for it all....

Internet troll ordered to pay $500

FAIRFAX NZ
TRISTAN BARKER: The Rotorua teenager has been convicted and discharged for an assault on Sydney TV reporter David Eccelston in March.

Internet troll Tristan Barker has today been convicted and discharged in the Rotorua District Court and ordered to pay a $500 emotional harm payment.

Barker, son of former Split Enz drummer Michael Barker, had sought a discharge without conviction for an assault on Sydney television reporter David Eccleston in March.

He appeared upset as Judge Marie McKenzie delivered her verdict.

Mitigating factors put forward by Barker's lawyer, Bill Rawson, had some merit but she could find no evidence that a conviction would impact on Barker's career prospects. she said.

Barker's offer of an emotional harm payment had not specified an amount of money so was "not a front-footed offer by you", the judge said.

She said the assault, in which Barker struck Eccleston twice in the head, as "an assault on a stranger simply doing his job". The second blow, struck when Eccleston was attempting to walk away, was "gratuitous".

"I regard this assault as serious," she said.

"To consider this acceptable behaviour is a bad message to send."

While the police had not objected to the discharge without conviction, Eccleston had been opposed, Judge McKenzie said.

In his victim impact statement, Eccleston said he had suffered physical and psychological damage as a result of the assault.

"He has never felt more under threat for his personal safety. It was horrifying," Judge McKenzie said.

Of course its "fishing". They're trying to manipulate and so bully us into divulging info to use against us with more defamation, stalking and death threats.

The thing that makes Janice karaka Clarke special, is the way she finds it appropriate to harass her victims to the point of placing phone numbers, addresses, collegues, numbers, bussiness addresses and

naming and shaming any associate she can link to having dealt with her victims.

If it wasn't for her and the rest of you tag stakers this forum would be thriving with injured claimants and other real professionals.

She and you shithead tag team, (which includes you BLURB) have used this forum for harassing instead of helping people with acc issues and who are injured.
