26] A collateral question that was raised in this appeal was whether rape could be regarded as an injury per se. The history of abuse includes rape. I had held in a case reported as R N v ACC [2012] NZACC 273 that the bodily invasion of rape is not in itself a personal injury without evidence of actual personal injury. That case is the subject of an application for leave to appeal to the High Court. Mr Miller accepted that the point could not be taken further while that appeal is pending. For the purposes of this case, and any appeal that may be considered, I record the same conclusion as a matter of law.
