GASLIGHTING

How does UNUM murder people?

(Insurers actually do this MORE at Christmas - read our Update below.)

It’s called “gaslighting,” and they really do it, as do many other “friendly” insurers who claim to have good hands or be good neighbors..

Insurers often set out to drive people crazy on purpose, with malice aforethought, so that their victims and former trusting customers give up their claim or settle for a lowball. Or maybe just die or go away. In one case a company lawyer literally had an office party and a champagne toast when the “problem claimant” killed himself after becoming homeless.

Now and then we get suicide notes.

UNUM puts people through such a pitiless hell of lies, delays, cheats, and dirty tricks that they consider killing themselves. Even if they don't, they may perish of immune shock from the terrible toll of years of being tormented.

Please don't give up like this because you're doing exactly what UNUM wants - you're terminating their claim and the evil bastards get to save money and forget you. Why give them the satisfaction?

Even if they win the case, you can still afflict them. You have a voice. You have email, letters and a phone. You could even picket their offices. If their tens of thousands of victims all made noise instead of remaining silent, things would change.

UNUM uses endless tricks: lies and distortions: “losing” huge, long claim forms so you have to fill them out over and over, demanding ten year’s worth of bank, income, tax and even phone records that it’s nearly impossible to get, changing adjusters repeatedly, causing endless delays, making accusations, pulling dirty tricks, and even using terrorism to frighten claimants. (It’s called “rough surveillance.”).

All the while they pretend to be your “friendly” insurer, and lead you on with lies when they have no intention of ever paying the claim.

They keep getting your hopes up and then dash them.

The lawyers will say they are sending something and it never arrives. They make appointments and cancel them or don’t show up. You win a so-called binding arbitration and they ignore it.

You beat them in court and they appeal to a bought judge. You win every possible way and they simply “forget” to send the check and you have to sue them for that. There is no end to their criminality.

Many of their victims literally commit suicide out of grief and frustration, since they are disabled and unable to support themselves without the insurance they trustingly paid high premiums for all those years.

These actual cases of “engineered: suicide are mentioned in many places on this website and on the gaslighting page of our sister website at
Insurance Justice. But UNUM’s evil managers and lawyers don’t care. What’s a life compared to the bottom line?

This sort of reality distortion was a principal plot device in the play and movie, “Gaslight.”

A man marries a naive young woman and sets out to drive her crazy so that he can steal her jewels. Each time he leaves the house the gas lights dim and she hears footsteps on the floor above (he sneaks back in by a secret stairway, dims the light, and walks the floor.)

No one else notices and he insists that he was away. She begins to think she is crazy. The more the victim of Gaslighting trusts the person who is bending reality, the more the victim suffers.

Disability Insurance Scam By American Insurer

Wednesday, 30 April 2003, 8:59 am

Press Release: ACC Support-Action Group Canterbury

Disability Insurance Scam By American Insurer

Acc Support-Action Group Canterbury Acc Support-Action Group Otago

ACC claimants across the country have been shocked over the weekend to learn of a massive disability insurance scam against legitimate claimants by America's largest Disability Insurer, UnumProvident.

America's largest disability insurance company, UnumProvident has been told to "obey the law" in a stunning rebuke by a Federal District Court Magistrate after being accused in more than 3,000 lawsuits of cheating disabled people out of disability payments by using tactics such as losing and shredding files, employing biased doctors to justify cancellations, spying on people, withholding entitlement information from policy-holders and targeting specific categories of claims for cancellation.

U.S. claimants have already successfully sued UnumProvident and been awarded amounts up to $36 million by juries. U.S. Television programs 60 Minutes and Dateline carried extensive stories last November which shocked the nation after past and present employees confirmed the practices.

The employees also confirmed that there were incentives which could be a cake and ice cream or pizza party to monetary bonuses and salary-scale incentives. UnumProvident also introduced what it called a "hungry vulture" award for high performing staff who dumped claimants.

Newly elected Californian Insurance Commissioner, John Garamendi, who took office in January and is promising a full investigation said; " It appears to me to be a conspiracy to defraud individuals."

UnumProvident says with 25 million customers it is not surprising some cases are disputed but the media has investigated Unum Provident practices and say the number of lawsuits and the personal anguish they catalogue paint a disturbing portrait.

Ray Bourhis, a partner in San Francisco law firm Bourhis & Wolfson, has represented dozens of UnumProvident clients whose compensation was denied or they were dumped. "You shouldn't have to sue to get an insurance company to pay the benefits they owe you," he said.

Dr Patrick McSharry, a former medical director at UnumProvident, sued the company last June alleging it denied claims and asked doctors to justify denials. His lawsuit said he suffered retaliation for writing accident reports contrary to that practice.

McSharry's lawsuit triggered a stampede among lawyers suing UnumProvident for denying or dumping thousands of claims.

Dr William Feist, who resigned as vice president and chief medical officer in 1996 after 14 years with the company testified in a recent successful $7.6 million lawsuit by a female chiropractor who became injured and had her benefits cut off, her car repossessed, evicted from her home and forced to declare bankruptcy and was forced on to welfare because of UnumProvident's practices.

Dr Feist told the Court that the company held weekly "roundtables" to jettison claims. "The whole goal of the roundtable discussions was to do just that, to terminate claims," he said ".....to me that was unethical."

Feist said the company played hardball including unlawful investigations and seeking embarrassing information on clients. "Anything was fair game to try and terminate a claim -- surveillance or financial records, ex-wives, mistresses, whatever, anything was fair game," he said.

Another claimant, an injured court reporter, was recently awarded $1.2 million after suing the company.

ACC Claimant Support Groups say from the media reports they have seen the immensity and the audacity of the U.S. disability insurance fraud and the consequent pain and suffering which has been inflicted on claimants is so staggering as to defy imagination.

ACC claimants are extremely alarmed by the evidence of unlawful disentitlement, fraud and attempts to defraud by UnumProvident which, although a private disability insurer, is America's largest and has similar clout and influence to New Zealand's monopoly ACC.

This insurer's activities, methods, practices, even the language used, parallels that of New Zealand's Accident Compensation Corporation, claimants say.

We all know that ACC uses public documents and press releases with the intention, and is capable, of being used to obtain from the public the $2.2 billion it collects from them every year to provide rehabilitation, not forgetting that ACC proposes to have $5.5 billion of public levies it collects invested in financial markets by 2005.

ACC recently received an updated A+ superior rating from America's largest insurance rating agency A M Best. Following the weekend revelations this rating from an American insurance rating agency has made ACC claimants doubly suspicious.

We all know that the ACC levies and charges are compulsory but would the public continue to willingly pay and have confidence in the scheme if they knew what was going on?

ACC even goes so far as to continually tell the public and also a Parliamentary Select-Committee that claimants, including vulnerable long-term claimants, are being properly rehabilitated when many know that is not the case and, in fact, ACC has gone to extraordinary lengths not to provide rehabilitation entitlements to which claimants are eligible.

It has even adopted the public logo "Prevention - Care - Recovery" clearly intended and capable of being used to further convince the public that the money they pay is being put to all the purposes in the ACC Act.

Unum Provident uses the logo "You will have peace of mind."

ACC claimants say by its torment, degrading and cruel behaviour towards claimants ACC certainly does not meet the criteria in its public logo and it even has an agreement with ACC Minister, Ruth Dyson, to "exit" 1500 claimants this year just because they are long-term when the law provides for a full range of lawful rehabilitation entitlements for every claimant.

This has direct parallels with the American UnumProvident practices ACC Support Groups say.

By using or attempting to use documents as it does, ACC and its case managers have a purpose, prima facie, to obtain a privilege, benefit or pecuniary advantage or valuable consideration for themselves and their organisation.

If ACC's use, or attempts to use, any such document amount to an intent, or is capable of being used, to obtain any privilege, benefit, pecuniary advantage or valuable consideration which is, prima facie, an intent to defraud, the possibility then exists that such alleged activities can be investigated and, if found wanting, prosecuted under Section 229A of the Crimes Act.

Following the U.S. revelations ACC Support Groups are again calling on the Government and all politicians for a full public inquiry into the practices of ACC.

The Doctors of Death...

These so called Independent Medical examinations are what could be no simpler said...than a frigging joke.

These Doctors are the bread and butter of balancing the budget of the Washington State Department of Labor and Industries. Working as a separate entity from the claims managers, yet together for one common goal, which is denying legitimate claims at all costs.

Also see the new IME page http://www.jayfoster...0ime%20info.htm

A case in point in a recent investigative news report. A man pulled out of a chemical explosion at his work accumulated over $1,000,000 is medical bills, nearly died, and is now bankrupt because of the IME deny, stall tactics, he was told that he is making up his illness by the Labor and Industries IME doctors.

Read the full website, based in the USA. What theyve experienced is almoost identical to the experiences ACC claimants have.......

Medical Whores

As Well as the Good Guys:
Physicians Who Care http://graham.main.n...el/MED/pwc.html
A National Organization of Physicians and Patients
who've had enough of HMOs and "Managed Care".

It is an unfortunate fact of life that medical whores exist, and in alarming abundance. They are an embarrassment to the profession and should be routed from it; yet, they are not. To do so legally is almost impossible. In some of the more outrageous cases, the medical whore is known throughout the local medical profession, the legal profession, and are even a laughing stock of of the local judiciary. They are, of course, the spawn of insurance companies.

If you are sent, by an insurance company, to an "Independent Medical Evaluation" (IME) - that's what they call it - nine times out of ten you will be sent to one of the insurance company's medical whores. The purpose of the alleged "examinations" is to provide the insurance company with a good excuse not to make good on it's contract. (oops - pardon me: your insurance policy is not a contract; it used to be.) The insurance scam is that your state essentially puts a gun to your head, forcing to you purchase (specifically automobile) insurance policies. The insurance companies then collect the payments but then try to find every way, legal or illegal, but dishonest, *not* to pay you in the event of an accident. It used to be called "highway robbery", now in doublethink, it's called insurance, an oxymoron under current conditions, if there ever was one.

Government and insurance have forced their way into every aspect of your life. Physicians must carry malpractice insurance which is outrageously overpriced. Many "physicians" of middle grade find lucrative positions functioning as the whores for insurance companies. No matter how personable they may appear, they are not your friends. They are the worst of scum, not deserving of the title "physician".

Insurance companies have now developed a new way to crucify you. Take a large semirural area that depends heavily on one urban center that is not too large. Asheville in Western North Carolina happens to be perfect. Many people from WNC and from the foothills area rely on Asheville for specialized medical services. Insurance companies can buy off physicians or groups of physicians in the urban area, providing them with the names of people with claims against the given insurance company. You, then, are referred to some specialist or group of specialists quite unwittingly by a known and perfectly fine physician. You go to the specialist who then, because your name is on the list, writes a typical whore's report. Note that you have gone to this specialist as a patient, and been betrayed professionally; this is *not* an IME. The insurance company now has something better than its own IME, to use against you: your own physician.

An example:
There is a large nest of neurologists here in Western North Carolina, headquartered Asheville, who are servants of at least one insurance company known to me. I am in litigation against this particular insurance company. I unwittingly sought a neurological exam from one of the nest's neurologists. This particular neurological whore was highly recommended by several physicians whom I trusted regarding knowledge and integrity. Their recommendations were, I'm sure, based on technical grounds; I'm equally sure they had no idea of the total absence of integrity, morals or just common decency of the whore in question.

My partner made the first appointment for me. Oddly, *his* name was in their computer and it was so announced. Explanation: he received a fairly rude demand for an IME about a year ago. But, the space for who had requested the IME was left blank. Being in no condition to play games, he simply forwarded all material to his attorney, and forgot about it. He is also in litigation against the same insurance company as I am; in fact, the cases have been joined.

Guess what came back from my "own" neurologist? A report that is exactly what my insurance company would have wanted. The earmarks listed below were all present, right down to the outright lies of what actually happened, and what was said, as well as the inconsistencies of position. This particular medical whore then actually saw me under false pretenses, outwardly pretending to see me as a patient, while secretly treating my visit, to be paid by Medicaid, as an IME for State Farm "Insurance". The exact same kind of fraud and report was perpetrated on my partner. We immediately sent Certified Letters, RRR , revoking all authorizations for the release of any information to anyone. I've planned an endless slow sequence of punitive measures to be taken against the entire nest. Stay tuned. The essence of attack is surprise.

"It's Called Gaslighting."

written by Rod Hinchco - 5 May, 2003

Yes. it’s called Gaslighting and for the naive, the innocent and those who just plain haven’t heard of it, it is the ploy of the insurance industry, and a growing number of Government departments and State Owned Enterprises, in order to con genuine claimants out of their rightful dues.

It’s not ‘Spin’. We all know what ‘spin’ is. The Prime Minister, in fact, all politicians use it, but Helen Clark has become so adept, she has been crowned, the Queen of Spin, though there is no honour in it. No, it’s not spin. Nor is it ‘Flim Flam’. It's no ordinary confidence trick. Gaslighting is criminal, in that it can, more often than not, cause deep depression in the victim, worsening existing medical conditions and even prompting the sufferer to take their own life.

A favoured technique of the ‘Gaslighter’ is to win the victim’s confidence. To be totally agreeable. Black being black, and white being white, they become trusted and reliable reality checks for you, and then, subtly changing things so that, while appearing genuinely supportive and caring, they sell you black as being white, and white as black, until you begin slowly at first, to lose your marbles. Ultimately you become highly vulnerable. Trusted friends become proof that you are losing it. You become convinced that there is something wrong with you. You begin to rely after a while, on the honesty or perceived honesty of those around you. You become more and more convinced that you are ill and/or incapable of managing your affairs, and the Gaslighter has taken you over.

But why insurance companies? Well, it’s like this. The insurance company makes their money from you gambling in a way, against the loss of property, health, etc. You’re bet, is your premiums paid. If you don’t lose anything and therefore don’t make a claim, it’s a win, win situation I guess, but certainly for the insurance company.

If you do suffer a loss, say of property, a car say, then your bet has paid off. The insurance company will pay out against your loss and everyone will be happy. "Yeah, Right!"

The fact of the matter is it isn’t anything like that simple. Say your car was stolen from outside your home one night. They will pull all sorts of conditions out of the woodwork in order to reduce the payout to you. All sorts of excuses of how you contributed to the loss and therefore are in part responsible and how, as a consequence, you have to contribute to the cover. That’s usually over and above any excess.

Your car, they will tell you, should have been secure in a locked garage. It should never have been left on the street. That’s just one example, and I don’t want to spend too much time explaining property loss. Hell, even the police don’t care about it anymore, unless of course it is the property of someone with a bit of clout.

Gaslighters undermine your self belief, your self confidence, your self esteem. They are predominant in health insurance more than anywhere else. ACC for instance, is a health insurer. Nothing more, nothing less. The fact that it is also Government’s most effective Cash Cow aside from IRD is neither here nor there. ACC has a stable of Gaslighters. Their tactics are deliberately and strategically designed and developed to cheat you out of some at least, of your rights.

They admit, themselves that their ‘Case Managers’ those smiling, friendly people who put themselves forward as ‘Your’ Case Manager, representing you to ACC. Representing ‘Your’ best interests, are highly trained in negotiation.

Negotiation? To negotiate with whom? GGGeeezzzzz, you’re only claiming what is rightfully yours after all. Isn’t it in black and white? Isn’t it a clear policy, laid out in a contract between the people, who give up all rights to sue, and the Crown?

You might think so, but you would be wrong. It is a lie. It is a shameless bloody lie. It is a con, and it is legitimised by this Clark Government, just as it was by the National Carpetbaggers before them, and that is why, National in opposition appear spineless. They too, are to blame. Incidentally, they are also spineless.

Now in the interests of brevity, if you took these practices to the extreme. If for instance you suffered several years awaiting a court hearing against ACC, and then after all of the waiting and the deprivation, the court actually made a decision in your favour, and issued an order against ACC, who stalled paying out for another three years or so and demonstrated the fact that the courts are impotent, uncaring, and have bugger all to do with dispensing justice, and over this period, ACC have continued to deny you your rights, and have sent down a barrage of assessors on you, and then you find that rather than even assess you for your original injury, most of these assessors have been assessing you for an ailment consequent to the original injury, and the whole process has been a complete and utter waste of time. A complete con.

Your relationships with friends and family begin to breakdown. Your faith in your Doctor and lawyer is all but buggered and half of your kids have left home and your spouse is threatening to do the same. The bank is on your back about your mortgage so one day, when it seems all too much, you decide to do a gas test on your oven, before the gas company come to cut the service for non payment, or you go out into your garage and do CPR on your cars exhaust. You mix a final cocktail from your medications or some other equally heinous thing, then you will understand what a gaslighter does.

By association, the Labour led, coalition cabinet are ‘Gaslighters’. They are callous liars and thieves. They are responsible for the deaths of fellow New Zealanders, just like you and I, and those opposition MP’s, comfortable in their positions of professional bludgers off the tax payers of this country, are even worse, for they are, nobodies already and have nothing to lose from a fight for justice for the people. The people they will no doubt expect to vote for them come the next election, which incidentally, can’t come quick enough.

Anger at denial despite findings elsewhere

23 November 2003

Vietnam veterans are angry at New Zealand's continued reluctance to accept that troops were exposed to Agent Orange during the war despite overseas governments having long recognised it happened to their soldiers.

Politicians in Australia and America have admitted soldiers were sprayed during the conflict from 1962 to 1971 - admissions which saw thousands of veterans awarded compensation.

New Zealand deployed about 3200 soldiers to Vietnam and today about 2700 are still alive.

If the government agrees to fund treatment of medical conditions linked to the highly toxic dioxins it could face a monthly bill of more than $400,000, based on similar payments in the US.

NZ First MP and former soldier Ron Mark believes officials should finally admit to having exposed men to the herbicide.

"How is it that everyone else around the world understands the matter and we still don't? No amount of trying to duck the issue is going to make it go away.

"The most common of grievances is the way those affected have been treated, that great denial or reluctance on the part of successive governments to properly investigate the issue.

"The government owes these people and a proper inquiry will help alleviate some of the anger and the angst that still exists."

A government inquiry into the health of children of Vietnam soldiers in 1999, chaired by Sir Paul Reeves, failed to find "sufficient evidence of an association" between the spray and illnesses.

Only spina bifida was categorised as having limited or suggestive evidence of a link. The government started paying for care of veterans' children with that and cleft lip or palate two years ago.

Last year a report by Deborah McLeod, from Otago University's Wellington School of Medicine, caused uproar among former soldiers. She found there had been "very limited potential" for the soldiers to be exposed to Agent Orange in Vietnam.

Australia's Department of Veterans' Affairs has rejected a direct link with poor health and the spray but gives the benefit of the doubt to troops on a case-by-case basis. It also funds medical care to veterans' children born with cleft lip or palate, spina bifida, acute myeloid leukemia, and adrenal gland cancer.

The US began compensating veterans after a 1986 lawsuit raised the matter. Health care and compensation has been available to their children who suffer spina bifida for the past seven years.

Congress passed the Agent Orange Act of 1991, which requires ongoing research to find what other diseases might be related to the herbicide.

Found this bit of of info off the net :

DOW JONES BUSINESS NEWS 11-5-02

"Ailing workers sue UNUMPROVIDENT over denial of claims "

They discuss a class action suit that claims that UNUMPROVIDENT gives bonuses and promotions to its employees based upon( bet you have already guessed by now !! ) the number of claims they can deny !!!
MMmm seem to have heard this before <_<

Well now we know its true and by ACC are doing exactly this .
Doesnt this mean that good old Gary should be out there culling 'his STOCK'
as they are doing their job purely it seems at times for monetary gain.

If this is so then if we end up with a court case would that mean that the CM concerned that had got this money .
Should have to end up paying it all back to the claiment out of his/her own pocket .
And with interest LOL
Interesting theory Eh!!

Regards

Buddy

so we can just do the same to them.

I know of one branch manager is on his way.

I may as well join this club as well. Gaslighting. Unum = ACC/AON

Unum and AON NZ LTD in my opinion have/had the same case management practices when my file was with them during 2001 - 2002.

ACC said it was for "Better management!"

If DAVID WOODS the General Manager of AON NZ LTD is game enough to sue me for writing/thinking/believing this, then Mr David Woods is most welcome to instruct his companies Legal Eagles to comence legal procedings against me!

I shall naturally counterclaim for damages etc when you lose!

Mr Woods. Was Dr ROBERT PERCIVAL AON's Branch Medical Advisor or ACC's Branch Medical Advisor(?) because so far I have never ever got an answer to that question!

Mr DAVID WOODS. WHAT LEANNE MACDONNELL PUT ME THROUGHT IS VERY VERY ACURALLY DESCRIBED on these pages.

Tell me David, what is MacDonnells background. Did she work for Unum or one of their companies in south africa by any chance?

BLURB: Franciscus Van Helmond. TOTALLY SCREWED BY AON and ACC!
I won't be rolled over by a bunch of lowlife crooks!

Blurb, the people that ACC atract for employment are down and out.

look carefully at what is being done. The ones responcable are the ones that cive the orders.

Question Were do one find personal that will do as said with out questioning the motives or legality. these people come fron a service either military or the Police. In ACC it seams that they have gone for the Police as they know all the tricks of criminals and can always put into place proceedures to cover there actions up. You will notice that claim managers do not disclose where they worked previously and this is to hide there past or any conection with others that don't need to confuse and harrase claimants.

part of being a police man is to look at the gang culture and the way things are done. This is because the Police culture is very close in how the two orginisations work.

The ACC employe a large number of Ex Police directly or as private Investigators for the bully tactics used in the NZ Police to gain control over groups.

I have a fully documented file compliled over a 14 month period .
Starting with a letter regards it to Gary Wilson within the first three months of gaslighting being obviuose ...and him assuring me it was just not possible... so instead of actually fixing it I made sure we create an indisputable paper and recorded trail never expecting it to carry on for sooo long but the reality is it just compounded the matter .

It really is a sorded tale .. Once the guy has settled down again ,he is rather jaded at the moment and is recovering from the stress and trauma of it all we will be presenting Jan White with the file in total...

BUT its spells out gaslighting and leaves no question as to what was going on and the methedologies used ...
