Help
I would like some information please. My son is going to see a Dr Kanji in Northcote for an assessment for independance allowance. He was in a passenger in a MVA and suffered head,abdomen and multiple injuries.(1999) He has been assessed by the Pain Clinic as being 75% disabled so why the assessment by this ACC pet specialist. What sort of report does he do and the likes. Can anyone offer any suggestions and can my son can go to a Specialist of his choice.
As my son keeps telling me he would have much rather died in the accident than to put up with what he has been through from ACC. They have let him fall through the cracks on more than one occassion and were happy to let it be that way. It is stressful to see him like this as I have problems of my own with ACC, but I want what is best for him.

Sorry i cant help with info on kanji but i have found acc totally ignore any recomendations from the pain clinic in auckland.
Thats what has happened in my case and it appears acc only use reports from the pain clinic as advisory if they want to ,and is for acc';s benefit.
I believe your son should be given the option of choosing the doctor he see's for the IA. If im wrong im sure someone will correct me, but i refused to see a certain doctor for the IA and acc sent me to another.
although it was still their choice.

I did a review (assisted in it) for a friend and had Kanji's IA assessment redone... and the % increased... Kanji is only a GP...
Dr Tom Bracken is a far better choice... he upped my friends %...

All claimant's undergoing IOA, IMA, or VI assessment must be provided with a list of fully qualified Assessor's in their area to choose from.
If you are dubious about an Assessor that they have automatically directed you to then it is within your right to refuse to be assessed by that person and you can ask for a list of assessors to choose from in your area.
The Corporation will sometimes try to pressurise you in to going to an assessor of their choice by telling you that they are the only (ie: Assessor with Orthopaedic etc etc qualifications) that is available at that time. That is not good enough grounds to direct you only to that particular assessor and if you are not comfortable with that person DO NOT go to them (This is not non-compliance).
The Corporation are liable for the travel costs associated with you having to go to an assessor outside your area if they can not provide a suitable one in your area.
Don't be pushed around or pressured into something that has the potential to be very damaging to your ongoing claim with the Corporation.

Seems we both have sons that have had one hell of a time with ACC in my son's case it has been since 1990 and nothing has changed, no doubt there will be a lot more parents with younger folk out there with the very same problem, it is very difficult to handle when they have survived a serious accident only to be put on the scrape heap. I believe because of the long term cost to ACC they try very hard to down grade the seriousness of their injuries in order to save $$.

I just want to say a "big thank you" to the replies I have got and my son Mark thanks you too. A special thank you to Tomcat for the extra information via the phone. He really appreciates the info he has got. I just hope that I see a difference in his emotional state. It is so comforting to know of others who have been through the same scenario and offer their help and advice. We are truely blessed to have a support group such as ours where we can all help one another, so thank you once again.

Help needed again 
. On the other site, ACCSupportNZ someone had typed out some forms to request all your updated files etc, I have searched everywhere for them and cannot find them. I thought it would be a good idea to print one out so my son could get all his updated files. So if anyone knows where I can find it could they let me know please.

My Son sent away for all his updated files at the end of October, ie all copies of pathways notes etc. He rang his case manager 2 days ago wanting to know where they were as he hasn't received them yet. We gave them the 20 days to get them to him but they are stalling now for time, their reason is they are waiting for more information so they can send all the files he requested. What can he do now and what else can we do to hurry them up?

hi mizbe what you can do is email the privacy commission at [email protected], make a complaint saying that on such and such a day
you requested your files etc from acc and they have not sent you the files.
the privacy commission will write back, saying to you that they have written to acc
and given them 20 working days to supply an explanation, and that your complaint comes under privacy prncipal 6 and 11.
that will move them with lighting speed.

In regard to Kanji's report, I have just read through an IMA he did for a claimant. There were 15 jobs proposed in the IVA and he classed 12 as 'suitable'.
This is the worst assessment I have seen in three years of advocacy and I intend to take this all the way and hopefully get him assessed off ACC.
He correctly noted lifting, bending, twisting and driving as physical limitations then classed jobs involving these actions as 'suitable'.
This is why I consider these parasites as thicko's as all there wrongdoings are documented in everyones indivudual reports. ACC can wriggle out of this by saying they accepted the experts opinion but should they. I say NO as they have a responsibility to ensure these reports are correct. If they have no accountability for this then they also are THICK.
Can anyone beat 12 accepted but non-suitable jobs on one assessment. I'd love to hear about it if it is beaten.

Regarding your son's files not being delivered within the 20 working days:
If you made and OIA ( Official Information Act 1982 request in writing ) then you could do well to contact the Ombudsmen - freephone 0800 802 602 and then press 3 for the Christchurch branch of the Ombudsmens' Office who handle all ACC enquiries.
Doing this could well be useful in addition to the Privacy Comissioner's help.
The Ombudsmen are very helpful.

what message is that saying, when the Ombudsman has press 3# for ACC
enquiries, either the caseloads are bcoming bigger, or the ACC must be
experiecing some real problems, are the Ombudsman Office really helpful
or do they ring ACC and tell them of the complaint, so that it does not get
put into writing and therefore reduce the number of complaints. commonly

I have sent an email off to the privacy commission tonight, I await their relpy in anticipation. Thank you so much for your help and the same to all others who replied. Now for some good news.
My son has just been given back dated payment for independance allowance from Dec 1999, nice tidy little sum I might add and he will receive further weekly payments from now on. Now all we need is for ACC to pay him weekly instead of him being on an invalids benefit from WINZ. Surely thats not asking too much is it?
